Terms & Conditions

Checkmate Roofing and Construction Terms and Conditions

Effective Date: July 06, 2024

1. Agreement Overview

1.1. Agreement: These terms and conditions (the “Agreement”) establish the general framework for the provision of roofing services by Checkmate Roofing and Construction (“we,” “us,” or “our”).

1.2. Incorporation by Reference: This Agreement is intended to be read and interpreted together with any signed estimates, invoices, and residential or commercial service agreements provided by Checkmate Roofing and Construction. These additional documents may contain further details specific to your project and supersede any conflicting terms within this general Agreement.

2. Services

2.1. Scope of Work: We will provide roofing services as detailed in the written estimate or contract provided to you. This includes materials and labor required to complete the project.

2.2. Change Orders: Any changes or additions to the scope of work must be agreed upon in writing by both parties through a change order document. This will reflect any adjustments to the project cost and timeline.

3. Payment Terms

3.1. Down Payment: We require a minimum down payment of 50% to start all jobs. In cases where the down payment does not cover material costs, an additional upfront payment may be required.

3.2. Late Payments: Our estimates will outline specific due dates for progress payments and the final balance. While we do not assess a late fee, interest will accrue on any outstanding balance after the due date outlined in the estimate.

4. Warranty

4.1. Warranty Coverage: We provide a [10-15 year] warranty on our roofing services. This warranty covers defects in workmanship for materials we install. Additionally, we can offer extended manufacturer warranties on certain materials, which will supersede our workmanship warranty after 2 years. The specific terms and duration of these extended warranties will vary depending on the manufacturer and materials chosen.

4.2. Warranty Exclusions: The warranty is void if the roofing materials are not maintained properly as outlined in our recommendations, or if unauthorized repairs or modifications are made to the roof by any party other than Checkmate Roofing and Construction. This includes, but is not limited to, roof cleaning, repairs, and other work performed by another contractor or the homeowner.

5. Mechanics Lien

5.1. Right to Lien: We reserve the right to file a mechanics lien against your property in the event of defaulted payment. A mechanics lien is a legal claim against your property to secure payment for services rendered.

6. Insurance

6.1. Our Insurance: We maintain general liability insurance to protect against potential damages during the project. Additionally, our workers are covered by workers’ compensation insurance.

6.2. Your Property Insurance: You are responsible for ensuring that your property insurance covers any potential damages to your structure during the roofing process.

7. Debris Removal

7.1. Disposal: Removal of debris and tear-off materials from the project site is included in our estimates.

8. Dispute Resolution

8.1. Arbitration: Any disputes arising out of or in connection with this Agreement will be resolved through binding arbitration in accordance with the Construction Industry Arbitration Rules of the American Arbitration Association (AAA).

9. Governing Law

9.1. Jurisdiction: This Agreement shall be governed by and construed in accordance with the laws of the state in which the services are performed, without regard to its conflict of law provisions. We operate in the states of Missouri (MO), Tennessee (TN), Washington (WA), and Wisconsin (WI).

10. Entire Agreement

10.1. Integration: This Agreement, along with any signed estimates, invoices, and residential or commercial service agreements, constitutes the entire understanding between the parties regarding the roofing services provided by Checkmate Roofing and Construction. This does not cover Checkmate Roofing and Construction’s Privacy policy

We appreciate your interest in Checkmate Roofing. To streamline communication and ensure the best use of our time, we have established preferred methods for companies seeking to do business with us.

  • Cold Calls: We receive a high volume of calls, and unfortunately, unsolicited calls often disrupt our workflow. Therefore, we screen and report all cold call solicitations as spam and add them to our blacklist.
  • Email: If you wish to offer Checkmate Roofing a product or service, please send a detailed email to office@checkmateroofing.com. We will review your email and respond if interested.
  • Calendar Booking: Our calendar is managed through our website and social media channels. Any solicitor who attempts to book our services directly through these platforms will be blacklisted from Checkmate Roofing and all affiliated companies. Additionally, such actions may lead to a complaint filed with the Better Business Bureau (BBB) or a relevant governing agency.

This clause applies to all forms of solicitation, including but not limited to phone calls, emails, and social media messages.

We encourage you to respect our preferred channels of communication.

Disclaimer: This clause aims to inform potential solicitors about our preferred contact methods. It is not intended to be a legally binding contract. Checkmate Roofing Referral Program Terms and Conditions
